This Refund, Dispute, and Revenue Protection Policy ("Policy") is incorporated into and forms a material part of the Terms of Service governing the use of services provided by Castiglia AI, owned and operated by Anthony Castiglia.
By purchasing, subscribing to, accessing, or using any Castiglia AI products or services, you acknowledge that you have read, understood, and agree to be legally bound by this Policy.
All Sales Are Final
1.1 — No Refund Policy
Unless otherwise required by applicable law or expressly agreed to in writing by Castiglia AI, all sales, subscriptions, implementation fees, setup fees, consulting fees, custom development fees, AI services, and recurring service charges are final and non-refundable.
Due to the immediate allocation of resources, technology, infrastructure, labor, and intellectual property associated with service delivery, customers acknowledge that refunds are generally unavailable once services have been purchased or access has been granted.
1.2 — Customer Acknowledgment
By completing a purchase, the customer acknowledges and agrees that:
- Services may begin immediately upon purchase
- Resources may be allocated immediately upon purchase
- Access to software, AI systems, automations, consulting, or digital services constitutes delivery of value
- Refund requests based upon dissatisfaction, non-use, misunderstanding, change of business circumstances, or cancellation after purchase do not entitle the customer to a refund
Billing Obligations
2.1 — Responsibility for Charges
Customers are responsible for all fees, charges, usage costs, subscription fees, implementation fees, and other charges associated with their account. Customers are responsible for maintaining accurate billing information and ensuring sufficient funds are available to satisfy payment obligations.
2.2 — Failed Payments
Castiglia AI reserves the right to suspend, restrict, or terminate services immediately if payment cannot be successfully collected. Outstanding balances remain due and payable regardless of service suspension.
Chargebacks and Payment Disputes
3.1 — Required Notice Prior to Dispute
Customers agree to first contact Castiglia AI regarding any billing concern and provide a reasonable opportunity for resolution before initiating any chargeback, payment reversal, bank dispute, credit card dispute, processor claim, or similar payment challenge.
3.2 — Material Breach
Initiating a chargeback, payment reversal, or dispute for services that were delivered, rendered, performed, made available, or otherwise provided by Castiglia AI shall constitute a material breach of this agreement.
Upon such breach, Castiglia AI may immediately:
- Suspend services
- Disable accounts
- Revoke software access
- Cancel subscriptions
- Withhold future deliverables
- Refuse future service
without prior notice.
3.3 — Recovery of Costs
If Castiglia AI successfully demonstrates that disputed services were delivered, provided, performed, or made available, the customer agrees to reimburse Castiglia AI for all reasonable costs incurred in defending, responding to, or recovering amounts associated with the dispute, including:
- Chargeback fees
- Payment processor fees
- Bank fees
- Collection fees
- Administrative expenses
- Investigation costs
- Legal fees and attorney's fees where permitted by law
- Court costs where permitted by law
3.4 — Administrative Dispute Fee
Because chargebacks and payment disputes create significant operational burdens, customers agree that Castiglia AI may assess an administrative dispute fee of up to $250 per disputed transaction, in addition to any actual costs incurred, where permitted by applicable law.
3.5 — Fraudulent or Bad-Faith Chargebacks
Customers acknowledge that initiating a chargeback or dispute after receiving services, deliverables, software access, consulting, implementation services, AI services, custom work, or other contracted value may constitute a fraudulent or bad-faith chargeback if material facts are knowingly misrepresented. Castiglia AI reserves all rights and remedies available under applicable law to recover damages resulting from fraudulent or bad-faith disputes.
Revenue Protection
4.1 — Right to Collection
Customers agree that Castiglia AI may pursue collection of any unpaid balances through lawful collection methods, including:
- Internal collections
- Third-party collection agencies
- Legal proceedings
- Arbitration, where applicable
4.2 — Continuing Liability
Termination, suspension, cancellation, expiration, or non-use of services does not relieve the customer of responsibility for previously incurred charges.
Policy Updates
Castiglia AI reserves the right to modify, amend, or update this Policy at any time. Changes become effective upon publication on our website unless otherwise stated. Continued use of our services following any modification constitutes acceptance of the updated Policy.
Integration with Terms of Service
This Policy is incorporated into and forms part of the Castiglia AI Terms of Service. In the event of a conflict between this Policy and a separately executed written agreement signed by both parties, the written agreement shall control.
